Terms and Conditions of Sale and Service
These Terms and Conditions govern all contracts, quotations, and transactions between Secuvision Technology Pty Ltd (hereinafter referred to as “Secuvision”) and its customers. By placing an order with Secuvision, you acknowledge and agree to the terms set out below.
1. General
1.1 These Terms and Conditions apply to all sales and supply of equipment and related services by Secuvision, unless otherwise agreed in writing and duly signed by an authorised representative of Secuvision.
1.2 Any terms or conditions provided by the customer that are inconsistent with or conflict with these Terms and Conditions shall not be binding upon Secuvision unless expressly accepted in writing.
1.3 Secuvision reserves the right to amend these Terms and Conditions at any time without prior notice. The version in effect at the time of order placement shall apply.
2. Product Availability
2.1 Secuvision endeavours to dispatch all orders on the same or next business day.
2.2 Occasionally, due to stock shortages, import delays, or other circumstances beyond our control, certain items may be temporarily unavailable.
2.3 If your order cannot be shipped within one to two (1–2) business days, you will be notified by email or telephone, and an alternative product or revised delivery estimate will be offered.
3. Warranty
3.1 Warranty coverage applies only to the original purchaser and is non-transferable.
3.2 All Secuvision products are warranted to be free from defects in materials and workmanship for the period specified on the relevant product page or invoice.
3.3 The warranty does not cover damage resulting from, but not limited to:
- Misuse, negligence, or improper installation
- Electrostatic discharge, lightning strikes, or power surges
- Over-voltage, reverse polarity, or unauthorised modification
3.4 Warranty service is limited to repair or replacement of defective parts or products, at Secuvision’s sole discretion.
4. Lost, Damaged, or Delayed Shipments
4.1 Risk in the goods passes to the customer upon dispatch from Secuvision’s premises.
4.2 Secuvision accepts no liability for goods that are lost, damaged, or delayed after being handed to the carrier.
4.3 Optional freight insurance is available at a rate of 1% of the total order value, covering loss and transit damage.
4.4 Insurance must be requested and paid for at the time of order; it is not automatically included.
4.5 Claims for shortages or damages must be lodged in writing within 48 hours of receipt of goods. Claims submitted after this period may not be accepted.
5. Returns and Defective Merchandise
5.1 Due to the technical nature of Secuvision products, all sales are final. Returns for change of mind will not be accepted.
5.2 All items are functionally tested and visually inspected prior to dispatch.
5.3 In the event that a product is found to be defective during the applicable warranty period:
- Secuvision will, at its discretion, repair or replace the item.
- The customer shall be responsible for all freight charges associated with the return.
5.4 All returns require a valid Return Authorisation (RA) Number.
- To obtain an RA, contact Secuvision by phone or email and provide a copy of your purchase receipt along with a brief description of the fault.
- Upon approval, an RA number will be issued (usually via phone or email).
- The RA number must be clearly displayed on the outer packaging of the returned goods.
- Returns without a valid RA number will not be accepted.
6. Legal Responsibility
6.1 The purchaser is solely responsible for ensuring compliance with all applicable local, state, and federal laws regarding the possession, installation, and use of any product supplied by Secuvision.
6.2 By placing an order, the purchaser warrants that they are of legal age and that all products will be used for lawful purposes only.
6.3 Secuvision shall not be liable for any injury, loss, or damage arising from the use or misuse of any product supplied.
6.4 Secuvision makes no representation regarding the legality of specific product applications, including but not limited to audio or video recording without consent. Customers are strongly advised to seek independent legal advice to ensure compliance with applicable laws and regulations.
7. Limitation of Liability
7.1 To the fullest extent permitted by law, Secuvision’s total liability, whether in contract, tort (including negligence), or otherwise, shall not exceed the total price paid for the goods giving rise to the claim.
7.2 Secuvision shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, business interruption, or loss of data, even if advised of the possibility of such damages.
7.3 Nothing in these Terms and Conditions excludes, restricts, or modifies any rights or remedies that cannot be excluded under the Australian Consumer Law.
8. Force Majeure
8.1 Secuvision shall not be held liable for any delay, failure, or inability to perform its obligations due to causes beyond its reasonable control, including but not limited to natural disasters, fire, flood, earthquake, pandemic, war, embargo, industrial disputes, or interruptions in transportation or power supply.
8.2 In such circumstances, Secuvision’s obligations shall be suspended for the duration of the event, and delivery times shall be extended accordingly.
9. Governing Law and Jurisdiction
9.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales, Australia.
9.2 The parties agree to submit to the exclusive jurisdiction of the courts of New South Wales for any disputes arising under these Terms and Conditions.
